メンバーシップに関する承認事項

本同意書では下記のとおり、契約者を「契約者」または「貴殿」と表記し、また 「avs-museum.com」 を「AVS-MUSEUM.COM」または「我々」と表記する。本同意書は、 「AVS-MUSEUM.COM」 より契約者に対しユーザIDならびにパスワードが発行された時点から有効となり、サービスに関するすべての料金も同様に、契約者に対しユーザIDならびにパスワードが発行された時点から起算される。

1.法律および地域社会の規範に対する準拠

契約者は自らの居住する地域社会における風俗系メディアに関する規範・法律を理解し、 「AVS-MUSEUM.COM」 におけるアダルト映像の送受信の閲覧がこうした規範・法律に違反しないことを言明する。また、契約者は本サイトの題材を要求、受信、処理することに関し、「AVS-MUSEUM.COM」 に一切の責任がないことを言明し、本同意書の規約に同意する。

2.アダルトコンテンツ閲覧に関する同意

このウェブサイトは、アダルトまたはポルノに類される性的画像、言語、および音声へのアクセスを希望する成人（18歳以上もしくは居住する司法管轄権における成人年齢に達している個人）だけを対象に作成されたものである。本ウェブサイト内の題材には、裸体および性行為が描写されており、17歳以下もしくは居住する司法管轄権における成人年齢に達していない個人、またはこうした内容の表示を望まない成人は、これにアクセスしてはならない。メンバーシップを購入することで、契約者は以下のことを宣言し、その内容に同意する。「偽証罪告知の下、契約者は自分が18歳以上もしくは居住する司法管轄権における成人年齢に達しており、17歳以下もしくは居住する司法管轄権における成人年齢に達していない個人に対し、このウェブサイトに含まれる題材へのアクセスを禁止することを約束し、ここに宣誓する。契約者は、本ウェブサイトへのアクセスにより、アダルトまたはポルノに類される性的画像、言語、および音声が表示されることを理解し、自らの娯楽、情報収集、教育を目的に、本サイトに含まれるあらゆる題材の視聴を希望する。このサイトの閲覧は、契約者の住む地域社会における平均的成人個人が持つ健康的かつ一般的な性への関心・興味を表す行為である。契約者は自らの居住する地域社会におけるこのような性的題材の許容度をよく理解し、本サイトの題材が当該地域社会で許容されるものであるとみなす。契約者は、当該地域社会に居住する平均的成人が、未成年またはこうした題材の閲覧を希望しない成人に対してのアクセスを禁止するという状況下で、本サイトの題材を容認・消費し、また本サイトの題材を猥褻または不快と認識することがないと判断する。」

3.メンバーシップ料金

ウェブサイト（「サービス」と呼ぶ）が提供するサービス、情報および製品の使用を目的にした本サイトへのアクセスに対し、指定期間ごとに 「AVS-MUSEUM.COM」 のメンバーシップ料金が請求される。契約者がメンバーシップの解約手続きを行うまで、現行のメンバーシップ料金が指定クレジットカードに毎月課金される。こうした売上げに対し、返金は一切されない。

4.価格、コンテンツ、契約条件変更の権利

「AVS-MUSEUM.COM」 は、価格、ウェブサイトのコンテンツ、およびこの契約条件のすべてを、いかなる時にも自由に変更する権利を有する。契約者は契約条件および価格に変更の有無を定期的に確認し、こうした変更が提示された後に 「AVS-MUSEUM.COM」 を継続使用した場合には、その変更を受け入れたものとみなされる。

5.強制退会およびサービスの一時停止

契約者がこの契約条件に違反した場合、または明らかにこれと矛盾する行動を取った場合、また理由のいかんを問わず、「AVS-MUSEUM.COM」 はその自由裁量で、契約者あるいはあらゆる個人に対するサービスの中止、および/または一時停止する権利を有し、またこうした処分に対して、事前通知の義務を一切負わない。「AVS-MUSEUM.COM」は、契約者またはいかなる個人の本ウェブサイトへのアクセス権が取り消しまたは一時停止された場合にも、一切の責任を負わない。

6.契約者による退会

契約者がメンバーシップの取り消しを希望する場合には、最低でもアカウントの失効1週間前に、退会届を退会フォームより届けねばならない。

7.免責事項

「AVS-MUSEUM.COM」はサービスに関していかなる保証もせず、(1) サービスの可用性、サービスの正確性およびその内容、(2) 商品的確性または利用目的との適合性に対する保証から一切免責される。また、システムパフォーマンスの不具合、過失、省略、中断、削除、欠陥、倒壊による遅延、改ざん、または記録の使用（または記録への不正アクセス）に関する 「AVS-MUSEUM.COM」 およびその幹部、取締役、従業員、代理人、独立系業者の責任は、それが契約や保証の違反、またはその他の不法行為に該当するか否かに関わらず、損害または被害の報告があった月に支払われたメンバーシップ料金を限度とする。

8.コンピュータのシステム要件

本ウェブサイトおよび「サービス」へのアクセスに必要なパソコン、テレコミュニケーション用機器およびインターネットアクセスは、すべて契約者の負担となる。画像のダウンロードが困難等の理由で「サービス」の完全使用が不可能な場合、また契約者のコンピュータや契約者が契約しているインターネット・サービスプロバイダーの性能に問題があって、こうした不具合が発生している場合、「サービス」に対し支払われた金額は一切返金されない。

9.ユーザIDおよびパスワード

「サービス」へのアクセスおよびその使用には、ユーザIDとパスワードが必要となる。セキュリティ保護のため、「AVS-MUSEUM.COM」では、絶対にパスワードを公開しない。「サービス」への不正アクセスは本同意書の契約違反および法律違反となる。

10.提供情報の真実性

契約者は「サービス」の契約に必要な全ての情報を提供したことまたその内容が正しいことを保証する。この契約はいかなる個人または団体にも譲渡することは出来ない。また、「サービス」利用料金の支払いに使用しているクレジットカードの有効期限の変更、住所・請求先住所の変更、IDまたはパスワードの喪失、盗難、不正使用、不正公開など明らかなセキュリティ違反があった場合には、ただちに 「AVS-MUSEUM.COM」に連絡しなければならない。「サービス」の不正使用により発生した損失・損害に関し、AVS-MUSEUM.COMは一切の責任を負わない。契約者が要求した場合、契約者は「サービス」の使用料金に関する請求記録へのアクセスが与えられる。

11.禁止行為

契約者は (1) 「AVS-MUSEUM.COM」 が所有・保有しているデータのコピー防止コードの解読、(2) 個人的利用目的以外での「サービス」上の題材の使用、(3) 「AVS-MUSEUM.COM」 または第三者の損失・損害を生むあるいはその原因となるような行為、(4) 契約者が居住する地域社会の風俗系メディアに関する法規や標準に違反する行為、(5) 公共のインターネット接続を妨害するような行為、(6) その他、 「AVS-MUSEUM.COM」 が不適切と定める全ての行為、など、 「AVS-MUSEUM.COM」 が定めている禁止行為を行ってはならない。

12.免責

契約者は契約者による本ウェブサイトの使用または不正使用に関わって、第三者から求められたあらゆる苦情、費用、要求（弁護士費用を含む）に関し、「AVS-MUSEUM.COM」およびその幹部、取締役、従業員、代理人、独立系業者の責任を問わない。 「AVS-MUSEUM.COM」 は、契約者により免責されたいかなる懸案に関し、それを管理する権利および自らを守る権利を有する。問題への抗弁に関し、契約者は 「AVS-MUSEUM.COM」 に協力すること。

13.複製の禁止

公のドメインおよび電子メッセージを除き、「サービス」に表示される全ての題材には著作権が発生している。このため、 「AVS-MUSEUM.COM」 からの事前の書面による通知あるいは本同意書に明確にその旨が記載されている場合を除き、こうした題材の複製、再配信、またはダウンロードを禁止する。

14.私的使用

「サービス」上の題材は、私的かつ非商業目的で、契約者の娯楽のためだけに使用されるものであり、その他を目的とした使用は一切禁止する。

15.本同意書

本同意書には、「サービス」の使用に関する契約者と 「AVS-MUSEUM.COM」 完全な了解事項を含み、かつ過去の書面または口頭による全ての了解事項に優先する。また改正は、 「AVS-MUSEUM.COM」 から契約者への告知を持ってのみ行われるものとする。明確に記述がある場合を除き、ここに書かれた条項は本同意書の満了まで有効とする。本同意書は、米国カリフォルニア州法に準拠する。

Terms and Conditions of Usage:
Membership Agreement

As used herein, subscriber shall be referred to as "Subscriber" or "you" and AVS-MUSEUM.COM as "AVS-MUSEUM.COM" or "we." This Agreement will take effect when a user ID and password is issued to Subscriber by AVS-MUSEUM.COM. Accordingly, all charges for the Service shall commence upon issuance of the user ID and password to Subscriber.

1. Compliance with Laws and Community Standards

You are familiar with and understand the standards and laws of the community in which you live regarding sexually oriented media. You represent that, based on your familiarity with these standards and laws of your community, by requesting and receiving any of the adult material on AVS-MUSEUM.COM; you will not be violating any of these standards and/or laws. You understand that by accepting the terms of this Agreement, you will hold AVS-MUSEUM.COM harmless from and against any responsibilities related to your requesting, receiving or possessing materials contained on its site.

2. Agreement to View Adult Material

This website is designed and intended SOLELY for ADULTS - people who are at least 18 years old (or the legal age of majority in the jurisdiction in which you reside) -- who are interested in and wish to have access to visual images, verbal descriptions and audio sounds of a sexually oriented, frankly erotic nature. The materials which are available within this website may include graphic visual depictions and descriptions of nudity and sexual activity and should NOT be accessed by anyone who is younger than 18 years old (or the age of legal majority in the jurisdiction in which you reside) or who does not wish to be exposed to such materials. 3. Membership Fees

You will be billed a membership fee in accordance with the designated schedule to gain access to this website for usage of the services, information and products offered by the AVS-MUSEUM.COM website (the "Service" or "Services"). You understand your credit card will automatically be billed each month for the current membership fee until you request cancellation of your membership. All sales are final. There will be no refunds, including partial refunds.

4. Right to Change Pricing, Content and Terms & Conditions

You agree that AVS-MUSEUM.COM has the right to change all pricing, website content and these Terms & Conditions at any time. Subscriber should check the Terms & Conditions and pricing periodically for changes. Your continued use of the AVS-MUSEUM.COM website following the posting of any changes shall be deemed as your acceptance of such change(s).

5. Termination or Suspension of Service by AVS-MUSEUM.COM

AVS-MUSEUM.COM reserves the right, in its sole discretion, to terminate and/or suspend the Service to you or any person without prior notice and for any reason, including, without limitation, if AVS-MUSEUM.COM believes that you have violated or acted inconsistently with the letter and spirit of these Terms & Conditions. You acknowledge and agree that AVS-MUSEUM.COM shall not be liable to you or any third party for any termination or suspension of your access to this website.

6. Cancellation of Service by Subscriber

If you desire to cancel your membership, please send a customer care representative a Cancellation Request Form at least one week prior to the date of expiration of your account.

7. Disclaimer of Warranties

You understand and agree that no warranty is made by AVS-MUSEUM.COM regarding the Service, and AVS-MUSEUM.COM hereby expressly disclaims: (1) any and all warranty as to the availability, accuracy or content of available through the Service; And (2) any warranties of merchantability or fitness for a particular purpose. You further understand and agree that any liability of AVS-MUSEUM.COM, its officers, directors, employees, agents or independent contractors, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in destruction, alteration, or use of (or unauthorized access to) records, whether for breach of contract, breach of warranty, negligence or other tortuous behavior, shall be strictly limited to the amount paid to AVS-MUSEUM.COM by or on behalf of the claimant for Service membership fees for the month in which the claimed injury or damage occurred. Under no circumstances will AVS-MUSEUM.COM or its officers, directors, employees, agents or independent contractors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, the AVS-MUSEUM.COM website.

8. Computer System Requirements

You are responsible for providing all personal computer and telecommunications equipment and Internet access necessary to gain access to the website and Services. In the event that you are not able to fully utilize the Service (i.e. due to difficulty downloading images etc.), and said failure is the result of poor performance of your computer system or Internet Service Provider, you shall not be entitled to any refunds of any amounts paid for the Service.

9. User ID and Password

Access to and use of the Service is through a combination of your user ID and password. Each Subscriber must keep his or her password strictly confidential. For security reason, AVS-MUSEUM.COM will not release passwords for any reason. Unauthorized access to the Service is a breach of this Agreement and a violation of law.

10. Information Accuracy

You hereby represent and warrant that any and all information provided in subscribing for the Service is complete, truthful and accurate. Subscribership may not be assigned or transferred to any other person or entity. You must promptly inform AVS-MUSEUM.COM of the following: changes in the expiration date of any credit card used in connection with the Service; changes in home or billing address; and apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. AVS-MUSEUM.COM shall not be liable for any losses or damages incurred by you as a result of unauthorized use of the Service. Upon request, you will be given access to billing records that support charges for use of the Service

11. Prohibited Actions

You shall not engage in the following actions, which are strictly prohibited: (1) any action that is designed to crack the anti-copy code of any data owned or held by AVS-MUSEUM.COM, (2) the use of material on the Service for any use other than your private, personal use, (3) any action that causes or results in any losses or damages to AVS-MUSEUM.COM or any third party, (4) any action that violates the standards and laws of the community in which you live regarding sexually-oriented media, (5) any action that obstructs the normal utilization of Internet connections to the public, and (6) any other action which is determined to be improper by AVS-MUSEUM.COM.

12. Indemnification

You agree to indemnify and hold AVS-MUSEUM.COM and its affiliates, and their respective officers, directors, agents, partners, contractors and employees harmless from and against any and all claims, expenses, and demands, including attorneys' fees, made by any third party due to, arising out of, or asserted in connection with your use or misuse of this web site, including claims relating to your use of this web site. AVS-MUSEUM.COM reserves the right to have control of any defense and control of any matter otherwise subject to indemnification by you. You agree to cooperate with AVS-MUSEUM.COM in asserting available defenses.

13. Copyright

Except for public domain material and electronic messages, all material displayed on the Service is copyrighted and may not be copied, redistributed or downloaded, in whole or in part, without the prior written consent of AVS-MUSEUM.COM, unless otherwise clearly stated in this Agreement.

14. Private Use

The material on the Service is for the private, non-commercial enjoyment of Subscribers only. Any other use is strictly prohibited.

15. NOTICES

Notices from AVS-MUSEUM.COM to Subscribers may be given by means of e-mail or by general posting on AVS-MUSEUM.COM, which may include, but may not limited to, promotions, special offers, and other information about AVS-MUSEUM.COM and/or any other website(s) or business(s) affiliated with AVS-MUSEUM.COM. Furthermore you hereby acknowledge and accept that by submitting a request for membership to AVS-MUSEUM.COM, whether the submission is successful or unsuccessful, that you are subject to receiving such Notices from AVS-MUSEUM.COM, and/or any other website(s) or business(s) affiliated with AVS-MUSEUM.COM. Communications from You to the Company may be made by e-mail.

16. MISCELLANEOUS

This Agreement contains the entire agreement between the Subscriber and AVS-MUSEUM.COM regarding the use of the Service, and supersedes all prior written and oral understandings and writings, and may only be amended upon notice by AVS-MUSEUM.COM to Subscribers. Unless otherwise explicitly stated, the provisions of this Agreement shall survive until its terminations. This Agreement shall be governed by and construed in accordance with the law of the domicile of AVS-MUSEUM.COM without prejudice to the mandatory rules of the courts hearing the matter.
